PETX JETS PET RELOCATION SERVICES

Contract of Carriage and Terms and Conditions

1. Incorporation of Participation Agreement

When you purchase a seat on a flight arranged by PETX JETS PET RELOCATION SERVICES and operated by a licensed air carrier (the “Carrier”), this Contract of Carriage forms part of and is incorporated into your Participation Agreement with PETX JETS PET RELOCATION SERVICES.

The Carrier is an intended third party beneficiary of the Participation Agreement. By completing your booking, you agree to comply fully with both this Contract and the Participation Agreement.

2. Compliance with Aviation and Security Regulations

All passengers must comply with applicable aviation and security regulations, including but not limited to rules issued by the Transportation Security Administration, the Federal Aviation Administration, and any relevant local or international regulatory authority.

Passengers are responsible for reviewing official guidance relating to prohibited or restricted items prior to travel. The Carrier reserves the right to enforce all applicable regulatory requirements in order to maintain its operating certifications and authorisations.

3. Prohibited Items and Zero Tolerance Policy

The Carrier operates a strict zero tolerance policy regarding illegal substances, smuggling, or unlawful conduct.

The Carrier reserves the right to inspect any baggage, containers, or personal belongings brought onboard by passengers or their accompanying guests. Any item considered unsafe, unlawful, or in violation of aviation regulations may result in denial of boarding.

If unlawful activity is suspected or detected, the passenger may be denied boarding, removed from the aircraft, or reported to the relevant authorities. For international flights, the aircraft may divert or return to a departure point if required to address a security or legal concern.

4. Firearms and Ammunition

Firearms and ammunition are strictly prohibited unless prior written approval has been granted by the Carrier.

Passengers wishing to transport a firearm or ammunition must notify PETX JETS PET RELOCATION SERVICES no later than five business days before departure and provide full details, including type and quantity.

All approved firearms must be unloaded, secured, and stored in accordance with applicable aviation regulations. Ammunition must be transported separately and in compliance with regulatory limits. The Pilot in Command retains final authority regarding whether any weapon or related item may be carried onboard.

5. Alcohol Consumption

The Carrier and flight crew reserve the right to refuse alcohol service to any passenger who appears intoxicated or who, in their sole discretion, has consumed excessive alcohol. Passenger conduct must remain respectful and compliant with crew instructions at all times.

6. WiFi and Onboard Amenities

WiFi or other onboard amenities may be available on certain aircraft but are not guaranteed. The temporary or full unavailability of WiFi or other amenities shall not entitle passengers to any refund, credit, or fare adjustment.

7. Animal Travel Requirements and Passenger Responsibilities

Passengers travelling with pets must comply with the following safety requirements:

  • Dogs must remain on a leash at all times, including within private terminals and onboard the aircraft.
  • Passengers must carry a suitable muzzle for each dog and present it at check in if requested. The muzzle must be fitted if instructed by the flight crew or PETX JETS PET RELOCATION SERVICES personnel.

Passengers are fully responsible for the behaviour and control of their animals. Failure to comply with crew instructions or safety requirements may result in denied boarding or removal from the flight.

The passenger agrees to indemnify and hold harmless the Carrier, PETX JETS PET RELOCATION SERVICES, crew members, staff, contractors, and fellow passengers against any claim, injury, damage, loss, or expense arising from the conduct of the passenger or their animal.

8. Independent Contractors

PETX JETS PET RELOCATION SERVICES acts as an organiser and facilitator of flights operated by licensed third party air carriers. The Carrier operates independently and is not an employee or agent of PETX JETS PET RELOCATION SERVICES.

Except where required by applicable law, the Carrier shall not be liable for loss, injury, delay, damage, illness, or death resulting from:

a) Acts or omissions of PETX JETS PET RELOCATION SERVICES or its contractors

b) Events outside the direct control of the Carrier

c) Force majeure events, regulatory actions, or operational constraints

Liability, where applicable, shall be limited in accordance with governing aviation conventions and applicable law.

9. Governing Law and Limitation of Liability

This Contract shall be governed by and interpreted in accordance with the laws specified in the Participation Agreement or, if not specified, the principal place of business of the operating Carrier.

To the maximum extent permitted by law, neither the Carrier nor PETX JETS PET RELOCATION SERVICES shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of revenue, loss of opportunity, loss of anticipated profits, or loss of use.

The rights and remedies outlined in this Contract are in addition to any rights available under applicable law or international aviation conventions.
